LEGAL MECHANISMS FOR THE PROTECTION OF PROPERTY EXPECTATIONS IN THE LIGHT OF MODERN LEGAL REFORMS: A SYSTEMATIC REVIEW

Abstract

The study of legal mechanisms for protecting property expectations is an urgent task for modern legal science, as in the context of reforms and legal uncertainty, guaranteeing expected property rights becomes particularly important. Existing theoretical approaches and law enforcement practice reveal contradictions in the interpretation of the concept of "property expectations" and its relationship to the "legitimate expectations" category used by the European Court of Human Rights. In this regard, there is a need for a comprehensive analysis of legal instruments that ensure an appropriate level of protection of expected property rights. The purpose of the study is to clarify the possibilities of modern legal development in providing adequate protection for property expectations. The work uses the PRISMA methodology to form a sample of scientific sources. The study included 45 sources of various types (monographs, empirical and review articles, conference proceedings), selected according to precise criteria. The chronological framework was 2016–2025. The results showed that regulatory approaches to protecting property expectations are based on the implementation of a set of principles and individual mechanisms. The quantitative ratio of protection instruments was established: 42% of the studied sources emphasize civil law mechanisms, 31% - administrative law, and 27% - judicial mechanisms. The decisions of the ECHR play a significant role, using the Convention for the Protection of Human Rights as an instrument to guarantee property expectations.

Dmytro Lutsenko is the Executive Director of the Association of Distributors of Ukraine, Managing Partner of the law firm “Novels,” and a GR specialist in the defense sector. He holds degrees in Law (2009) and Business Economics (2024). He has significant experience in regulatory work, tax policy, and economic security, focusing on combating the shadow economy, improving the investment climate, and aligning national regulations with EU standards. He cooperates with key state institutions, including the Ministry of Finance, the State Tax Service, and the Bureau of Economic Security. His professional interests include economic policy, excise taxation, compliance, and IP protection in the tobacco, FMCG, and defense industries. Since 2024, he has been a Board Member of ICC Ukraine and frequently participates in national and international business and legal forums. He is the author of analytical works and initiatives aimed at improving excise regulation, reducing illicit trade, and supporting the innovative development of Ukraine’s defense industry.

Krystyna Rezvorovych is the Doctor of Law, Associate Professor, Head of the Department of Civil Law Disciplines of the Faculty of Training of Specialists for Criminal Police Units of the National Police of Ukraine, Dnipro State University of Internal Affairs. Author of over 170 scientific works, 19 of which are educational in nature. She is a member of the authorship team of 8 monographs published abroad. She is the author of 2 individual monographic studies. She has 11 scientific articles in publications included in the international scientometric databases Scopus/Web of Science. Scientific interests cover a wide range of social relations: human rights, including social and economic rights; inclusivity and protection of vulnerable groups; various methods of alternative dispute resolution, such as mediation and arbitration; property rights relations; legal aspects of intellectual property law, copyright and related rights, digital technologies, cybersecurity and protection of personal data on the Internet. The Constitution of Ukraine establishes the strategic task of ensuring the functioning of an effective mechanism for the protection of social human rights by the state.

Mariia Vovk is an Associate Professor in the Department of Civil and Legal Disciplines at the Lviv State University of Internal Affairs (Ukraine). She holds a PhD in law and is an associate professor in the Department of Civil and Legal Disciplines. Vovk is the author of academic articles on civil law. She has authored over 30 articles in Ukrainian and 10 international academic journals, as well as a co-author of a collective monograph, a textbook, and 4 teaching aids. She has participated in numerous international and national academic conferences. Her research interests include corporate law, property law, intellectual property law, contract law and tort law.

Yuliia Sushytska is a Senior Lecturer in the Department of Law and Law Enforcement at Zhytomyr Polytechnic State University (Ukraine). She has over 20 years of teaching experience, including five years at her current faculty. Her academic work supports the development of deontological norms and contributes to advancing Ukraine’s European integration. Sushytska’s professional activities promote the strengthening of civil society and enhance both labor productivity and the quality of the educational process for higher education students.
